Effective from January 1, 2026
These terms and conditions govern access to and use of the real estate crowdlending platform operated by Xedvoni SpA. By registering or using our services, you accept these terms in their entirety.
1. Operator Identification
Xedvoni SpA, a company incorporated under the laws of the Republic of Chile, registered in the Santiago Commercial Registry under Folio 12847 of 2022, with Tax ID (RUT) 77.482.319-6, and domiciled at Av. Apoquindo 4700, Office 1203, Las Condes, Santiago.
The platform operates under the regulatory framework established by the Financial Market Commission (CMF) for collective financing and securities intermediation platforms.
2. Service Description
Xedvoni is a digital platform that connects investors with real estate construction and urban development projects in Chile through a crowdlending model. The platform allows registered users to contribute capital to selected projects and receive proportional returns.
Xedvoni acts as a technological intermediary between investors and project promoters. We are not a financial institution, bank, or insurance company, and invested funds are not covered by state guarantees.
3. Participation Requirements
To use the platform as an investor, you must be over 18 years of age, reside in Chile or in a country with an active double taxation agreement, and successfully complete the identity verification and due diligence process.
We reserve the right to reject registrations that do not meet regulatory requirements or that show signs of activities incompatible with our financial integrity policies.
4. Investment Process
Each project published on the platform includes detailed information about the promoter, location, budget, estimated timeline, identified risks, and projected profitability. This information is provided by the promoter and verified by our analysis team.
The investment is formalized through electronic acceptance of each project's specific conditions. Funds are transferred to a custody account managed by a regulated financial entity until the funding target is reached.
5. Investment Risks
All investment in real estate crowdlending carries risks, including the possibility of partial or total loss of invested capital. Projected returns do not constitute a guarantee of results and are subject to market variables, construction risks, and economic factors.
Xedvoni does not guarantee the profitability of any project nor assumes responsibility for losses derived from investments made through the platform. Each user is responsible for evaluating their risk tolerance before investing.
6. Fees and Costs
The platform charges a commission for the intermediation of each project, detailed in the specific conditions of each offer. There are no hidden costs: all applicable commissions are disclosed before the user confirms their investment.
Returns distributed to investors are subject to tax withholdings established by current Chilean legislation. Xedvoni provides the necessary certificates for your tax declaration.
7. Intellectual Property
All content on the platform, including texts, designs, logos, source code, and project analyses, is the property of Xedvoni SpA or its licensors and is protected by Chilean intellectual property laws.
The reproduction, distribution, or modification of the platform's content without express written authorization from Xedvoni SpA is prohibited.
8. Limitation of Liability
Xedvoni shall not be liable for indirect, incidental, or consequential damages arising from the use of the platform or from investments made. Our liability is limited to the amount of commissions actually received for the transaction in question.
We do not guarantee the uninterrupted availability of the platform and shall not be liable for temporary interruptions due to maintenance, technical updates, or force majeure events.
9. Dispute Resolution
Any dispute arising from these terms shall preferably be resolved through direct negotiation between the parties. In the event that an agreement is not reached, the parties submit to mediation by the Arbitration and Mediation Center of the Santiago Chamber of Commerce.
If mediation does not resolve the dispute, it shall be submitted to arbitration according to the rules of the aforementioned Center. The seat of arbitration shall be Santiago, Chile, and proceedings shall be conducted in Spanish.
10. Applicable Law
These terms are governed by the laws of the Republic of Chile. Applicable laws include, among others, Law 19,496 on the Protection of Consumer Rights, CMF regulations on collective financing platforms, and Law 19,628 on the Protection of Private Life.
Xedvoni is committed to adapting its operations and these terms to any regulatory changes applicable to its activity.
